FORE Elite Golf LLC ("FORE Elite Golf," "FORE," "we," "us," or "our") respects your privacy and is committed to protecting the personal information you entrust to us. This Privacy Policy (the "Policy") describes how we collect, use, disclose, retain, and protect personal information when you download or use the FORE Elite Golf mobile application (the "App"), visit our website at www.foreelitegolf.com (the "Site"), create or manage a membership, make reservations, or otherwise interact with our club locations, programs, and related services (collectively, the "Services").
This Policy applies regardless of the device you use to access the Services. It does not apply to information collected by third parties through websites, applications, or services that we do not control, even if you reach them through a link in the App or on the Site. Please review the privacy policies of any third-party services you use.
By downloading the App, creating an account, or using the Services, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, please do not use the Services. This Policy is incorporated into, and forms part of, our Terms of Service. Where permitted by applicable law, any dispute arising out of or relating to this Policy is subject to the dispute-resolution, governing-law, arbitration, class-action-waiver, and limitation-of-liability provisions of the Terms of Service. Nothing in this Policy limits any rights you have under applicable law that cannot be waived or limited by agreement.

We collect personal information in three ways: information you provide to us directly, information collected automatically when you use the Services, and information we receive from other sources. We collect only what we reasonably need to operate a premium, secure, reservation-based club experience.
Our club locations use technology to keep members, guests, and staff safe and to deliver a 24/7 reservation-based experience. This includes electronic access control (which records credential use and entry events tied to your account), video surveillance of interior and exterior common areas (excluding restrooms and other areas where surveillance is prohibited), and staff-attended identity and age verification for the purchase of age-restricted products such as beer and wine, conducted in accordance with applicable alcoholic-beverage laws. Notices are posted at our facilities where required. Surveillance footage is retained for a limited period and accessed only for safety, security, incident-review, and legal-compliance purposes.
The App may request access to certain device features, such as push notifications, camera (for example, to add a profile photograph), Bluetooth or NFC (for example, to support mobile facility-entry credentials where offered), and location. Each permission is optional and requested through your device's standard permission prompts. You may grant or revoke permissions at any time in your device settings; if you decline a permission, the related feature may not function, but you may continue to use the rest of the App.
We use personal information for the following purposes:
Aggregated and de-identified data. We may create aggregated or de-identified data that can no longer reasonably be linked to you, and we may use and disclose such data for any lawful purpose. Where we maintain de-identified data, we commit to maintaining it in de-identified form and will not attempt to re-identify it, except as permitted by law to test the effectiveness of our de-identification processes.
Where the EU or UK General Data Protection Regulation or similar laws apply, we process personal information on the following legal bases: (a) performance of a contract, where processing is necessary to provide the Services you request, including managing your account, reservations, payments, and facility access; (b) legitimate interests, such as securing our Services and premises, preventing fraud, improving the Services, and growing our business, balanced against your rights and interests; (c) consent, where required — for example, for certain marketing communications, precise location, or optional device permissions — which you may withdraw at any time without affecting prior processing; (d) legal obligation, where processing is necessary to comply with applicable law; and (e) vital interests, in rare cases involving the protection of someone's life or safety.
We do not sell your personal information for money, and we do not share it with third parties for their own independent marketing use without your consent. We disclose personal information only as described below:
No sale or sharing for cross-context behavioral advertising. We do not "sell" personal information, and we do not "share" personal information for cross-context behavioral advertising, as those terms are defined under California law, and we have not done so in the preceding 12 months. We do not knowingly sell or share the personal information of consumers under 16 years of age. If our practices change, we will update this Policy and provide any legally required opt-out mechanisms before doing so.
The Site and App use cookies, SDKs, pixels, local storage, and similar technologies to operate and secure the Services, remember your preferences, and understand how the Services are used. These generally fall into three categories: (a) strictly necessary technologies required for the Services to function, such as authentication and security; (b) functional technologies that remember settings and preferences; and (c) analytics technologies that help us measure performance and improve the Services.
You can manage cookies through your browser settings, including blocking or deleting them, and can limit SDK-based data collection through your device settings (for example, by resetting or limiting your device advertising identifier). Disabling certain technologies may affect the availability or functionality of the Services. Where required by law, we honor opt-out preference signals such as the Global Privacy Control (GPC) as a valid request to opt out for that browser or device. Because there is not yet a uniform industry standard, we do not otherwise respond to "Do Not Track" browser signals.
Email. You may opt out of promotional emails at any time by using the unsubscribe link in any promotional email or by contacting us. Opting out of promotional email does not affect transactional or service communications, such as booking confirmations and account notices, which we send as part of operating the Services.
Text messages (SMS/MMS). If you opt in to receive text messages from us, you consent to receive recurring messages related to your account, reservations, and — where you have opted in — promotions, at the mobile number you provide. Consent to receive marketing texts is not a condition of any purchase or membership. Message frequency varies; message and data rates may apply. Reply STOP to cancel at any time and HELP for assistance. Mobile carriers are not liable for delayed or undelivered messages.
Push notifications. You can turn push notifications on or off at any time in your device settings.
We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including maintaining your account and membership, complying with legal, tax, accounting, licensing, and insurance obligations, resolving disputes, enforcing our agreements, and maintaining security. To determine appropriate retention periods, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, whether those purposes can be achieved by other means, and applicable legal requirements. When personal information is no longer needed, we delete it, de-identify it, or securely archive it in accordance with applicable law. Video surveillance footage is retained on a short rolling basis unless preserved for an incident, investigation, or legal requirement.
We maintain administrative, technical, and physical safeguards designed to protect personal information against accidental, unlawful, or unauthorized access, use, alteration, disclosure, or destruction. These include encryption of data in transit, access controls and role-based permissions, network segmentation, vendor security requirements, and staff confidentiality obligations. Payment card data is handled by payment processors required to maintain PCI-DSS compliance.
No method of transmission over the internet or method of electronic storage is completely secure. While we work diligently to protect your personal information, we cannot guarantee absolute security, and, to the fullest extent permitted by applicable law, we are not responsible for circumvention of security measures by unauthorized third parties. You are responsible for keeping your account credentials confidential and for all activity under your account; notify us immediately at the contact details in Section 19 if you suspect unauthorized access. If a breach affecting your personal information occurs, we will notify you and applicable regulators as required by law.
Regardless of where you live, you may access and update most account and profile information directly in the App or through your online account, opt out of marketing as described in Section 8, control device permissions as described in Section 3, and contact us with any privacy question or request using the details in Section 19.
Depending on your state of residence (including, as applicable, California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, and other states as their laws take effect), you may have some or all of the following rights, subject to legal conditions and exceptions:
Exercising your rights. Submit a request by email to privacy@foreelitegolf.com or by mail to the address in Section 19, with "Privacy Rights Request" in the subject line. We will verify your identity using information associated with your account (and may request additional information where reasonably necessary to verify the request), respond within the time required by applicable law, and explain the reasons if we decline a request in whole or in part. Where permitted, an authorized agent may submit a request on your behalf with proof of authorization; we may require you to verify your identity directly. If we deny your request, you may appeal by replying to our decision with "Appeal" in the subject line; if your appeal is denied, you may contact your state Attorney General.
In the preceding 12 months, we have collected the categories of personal information listed below, from the sources and for the purposes described in Sections 2 and 4, and disclosed them for business purposes to the categories of recipients shown. We retain each category as described in Section 9.

California's "Shine the Light" law (Civil Code § 1798.83) permits California residents to request certain information about disclosure of personal information to third parties for their direct-marketing purposes. We do not disclose personal information to third parties for their own direct-marketing purposes.
If you are located in the EEA, UK, or Switzerland, you have the rights of access, rectification, erasure, restriction of processing, data portability, and objection (including to processing based on legitimate interests and to direct marketing), and the right to withdraw consent at any time without affecting the lawfulness of processing before withdrawal. You will not be subject to decisions based solely on automated processing that produce legal or similarly significant effects. You also have the right to lodge a complaint with your local supervisory authority (in the UK, the Information Commissioner's Office). We encourage you to contact us first so we can address your concern directly.
If you are located in Canada, you may request access to and correction of your personal information consistent with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, and may direct questions or complaints to us or to the Office of the Privacy Commissioner of Canada.
If the law of your jurisdiction grants you additional privacy rights, we will honor them as required. Contact us using the details in Section 19.
You may delete your account at any time from within the App (Settings ? Account ? Delete Account) or by emailing privacy@foreelitegolf.com from the email address associated with your account with the subject line "Delete My Account." When you delete your account, we will deactivate it and delete or de-identify your personal information, except where retention is required or permitted by law — for example, transaction and tax records, information needed to resolve disputes or enforce agreements, records of privacy requests, and security or incident records. Deleting your account does not automatically cancel a paid membership; please review your membership agreement or contact us to cancel billing.
We are headquartered in the United States, and the Services are operated from, and personal information is processed and stored in, the United States, where privacy laws may differ from those in your jurisdiction. If we transfer personal information from the EEA, UK, or Switzerland to a country not recognized as providing an adequate level of protection, we implement appropriate safeguards, such as the European Commission's Standard Contractual Clauses (and the UK Addendum or International Data Transfer Agreement, as applicable), and you may request information about these safeguards using the contact details in Section 19.
The App and Site are intended for general audiences and are not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13 without verifiable parental consent. Junior golf programs, lessons, and youth events must be booked and managed by a parent or legal guardian through the parent's or guardian's own account; in that context we collect only the limited information about the minor reasonably necessary to administer the program (such as name, age, and emergency contact), we do not permit minors under 13 to create their own accounts, and we do not use minors' information for marketing. If you believe a child under 13 has provided personal information to us directly, contact us at privacy@foreelitegolf.com and we will promptly delete it. As noted in Section 6, we do not knowingly sell or share the personal information of consumers under 16.
The Services may contain links to, or integrations with, third-party websites, applications, platforms, and services that we do not own or control, including the Apple App Store and Google Play. This Policy does not apply to those third parties, and we are not responsible for their content, privacy practices, or security. Any information you provide directly to a third party is governed by that third party's privacy policy, which we encourage you to review before providing information.
We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or the Services. When we do, we will post the updated Policy in the App and on the Site and revise the "Last Updated" date above. If we make material changes, we will provide additional notice as required by applicable law — for example, by in-App notice or email — and, where required, obtain your consent. Your continued use of the Services after the effective date of an updated Policy constitutes your acknowledgment of the updated Policy to the extent permitted by law. We encourage you to review this Policy periodically.
This Policy is incorporated into and forms part of our Terms of Service, which govern your use of the Services, including provisions on governing law, dispute resolution and arbitration, class-action waiver, disclaimers, and limitations of liability, each to the fullest extent permitted by applicable law. In the event of a conflict between this Policy and the Terms of Service concerning the handling of personal information, this Policy controls. Nothing in this Policy or the Terms of Service limits or waives any right you have under applicable data-protection law that cannot lawfully be limited or waived.
We are committed to making this Policy accessible. If you use assistive technology and need this Policy in an alternative format, contact us using the details in Section 19 and we will provide it.
