 Hereinafter referred to as the "Club."

Membership Dues:

   The Member agrees to pay membership dues as specified by the Club, in accordance with the payment schedule selected by the Member, herein attached.

   Dues are non-refundable unless otherwise specified by the Club.

Membership Privileges:

   The Member is entitled to use the Club's simulator golf facilities during normal operating hours and according to their membership type.

   The Member must reserve simulator time in advance, subject to availability.  The Member may book no more than five (5) hour weekend slots and ten (10) weekday slots in any single week.  When reserving within 48 hours of reservation, no limits apply.  

   The Member may bring guests, subject to the Club's guest policy, membership type, and additional fees, if applicable.  Member must accompany guest at all times.

  For Family Memberships, children under the age of 18 must be accompanied by a parent (children under the age of 18 may not have individual memberships).

Code of Conduct:

   The Member shall conduct themselves in a respectful and sportsmanlike manner at all times while on Club premises.

   Any violation of the Club's rules or disruptive behavior may result in disciplinary action, including suspension or termination of membership without refund.

   Effective and safe use of equipment is essential for both the individual member's well-being and the smooth operation of our organization. To ensure that all members can learn to use equipment safely and efficiently, we have established the following rules:

  All members must complete a training program specific to the equipment they intend to use prior to the use of any equipment or software.

  Members must read and follow the manufacturer's user manuals and guidelines for each piece of equipment. Manuals are available in the designated equipment areas.

  Only use equipment for its intended purpose. Unauthorized modifications, adaptations, or alternative uses are strictly prohibited.

  Conduct a pre-use inspection to ensure the equipment is in proper working condition. Report any defects or malfunctions immediately to the Club via e-mail at oakparkvirtualgolfclub@gmail.com.

  After each use, members are responsible for cleaning and maintaining the equipment in good condition, as outlined in the equipment maintenance procedures.

  Members must immediately report any accidents, near misses, or safety concerns related to equipment use to the appropriate supervisor or safety officer.  Member agrees to pay for damage to equipment and premises and third party property outside of Club caused by you and/or your guests (or guests’) careless use of equipment or other intentional or negligent acts. 

  Members are responsible for the behavior and safety of any guests or visitors they invite to use the equipment. Guests must comply with these rules.

  Member acknowledges that video recording will occur to monitor members’ use of facility.

Unforeseen Conditions:

  Internet services, including but not limited to broadband, Wi-Fi, and cellular networks, are subject to occasional disruptions due to technical issues, maintenance, unforeseen events, or other factors beyond our control. We make reasonable efforts to maintain a reliable service, but downtime can occur.  The Club does not offer refunds or compensation for internet disruptions, outages, or service interruptions, regardless of the cause or duration of the disruption. This policy applies to all customers and users.

 Termination:

   The Club reserves the right to terminate the Member's membership for violations of Club rules, conduct unbecoming a member, or failure to pay dues, without refund.

   Membership is non-transferable

Amendments:

  This Agreement may be amended by the Club upon written notice to the Member.

 RULES:

By participating in The Oak Park Virtual Golf Club (The Club), you agree to abide by the following safety and conduct rules, as well as other rules posted at the facility or communicated to you via e-mail.  Members are Guests are subject to all Rules and Regulations.

1. Only the player taking a turn is allowed near or on the mat.  All other members must stand behind the turf and on the carpet at all times until their turn to hit.  Members and guests are responsible for the safety of others around them and should always check their surroundings before swinging a club.

2. Please wear appropriate shoes; tennis shoes and spike-less golf shoes are permitted.

3. No alcohol or smoking is permitted in the facility.

4. Use clean clubs and golf balls free of debris, markings, abrasions, etc. 

5. Golf swings to be made in the hitting bay only.

6. You are under video surveillance; any damages to facility or equipment, or missing equipment, must be reported  immediately to oakparkvirtualgolfclub@gmail.com and repair fees may be charged to your member account.

7. No use of facilities while under the influence of alcohol and/or any drug, whether legal or illegal.  Any use of illegal drugs in the facility is grounds for immediate revocation of membership and no prorated portion of the Fee will be refunded.

LIABILITY WAIVER

Member hereby acknowledges that they have voluntarily chosen to become a member of The Oak Park Virtual Golf Club, LLC (The Club), located at 137 N. Oak Park Ave., Suite #127, and have been granted access to use the golf simulator facilities at the Club.  In consideration of being permitted to use these facilities, they agree to the following terms and conditions:

1. Assumption of Risk: I understand and acknowledge that the use of golf simulators, including but not limited to the use of golf clubs, balls, and related equipment, carries inherent risks and hazards, including the risk of physical injury, property damage, or other harm.  I voluntarily assume all such risks and hazards.

2. Release and Waiver: I, on behalf of myself, my heirs, executors, administrators, successors, and assigns, hereby release, waive, discharge, and convenant not to sue The Club, its owners, employees, agents, officers, and representatives (hereinafter collectively referred to as The Club) for any and all liability, claims, demands, actions, causes of action, costs, and expenses arising out of or in any way related to my use of the golf simulator facilities, including but not limited to those which may arise out of my negligence or the negligence of The Club.

3. Indemnification: I agree to indemnify and hold harmless The Club from any and all claims, liabilities, costs, or expenses, including but not limited to attorney’s fees, arising out of or in any way related to my use of the golf simulator facilities.

4. Medical Attention: I understand that The Club does not provide medical insurance coverage for injuries that may occur as a result of my use of the golf simulator facilities. 

5. Compliance with Rules: I agree to comply with all rules, regulations, and guidelines established by The Club for the use of the golf simulator facilities.  Failure to do so may result in the termination of my membership.

6. Full Understanding: I have read this Liability Wavier and fully understand its terms and conditions.  I acknowledge that I am waiving certain legal rights by signing this waiver and that I am signing it voluntarily and without an inducement or assurance of any nature.

7. Governing Law: This Liability Waiver shall be governed by and construed in accordance with the laws of Illinois.The Oak Park Virtual Golf Club Membership Agreement ("Agreement"):

At The Oak Park Virtual Golf Club (“the Club”) we know privacy is important to you. It is also vital to our business. This Privacy Policy describes the types of “Personal Information” (information that is identifiable to a particular person) that we collect in connection with products and services offered through the website at www.oakparkvirtualgolfclub.com (the “Site”), and explains how we safeguard your privacy as a user of those products and services. 

What Types of Personal Information We Collect: The Personal Information that the Club collects from or about you may include: Contact Information such as name, postal address, phone number, and e-mail address; Account numbers and other information on reservations/bill of sale; Information about bank credit card accounts, if you decide to make payments from those accounts through the Electronic Payment Site; Information to help verify your identity and authenticate your access to your information, products and services at the Club, including a password.

How We Collect Your Information: The Club may collect Personal Information about you from the following sources: Your online reservations or sales; Your use of the Club Site; Other sources, as allowed by law.  Additionally, when you visit the Club Site, we receive certain standard information that your browser sends to every website you visit, such as your IP address, browser type and language, access times and referring website addresses. This data does not identify you uniquely. However, it is used to assist in “authenticating” who you are when you access the Site. We may also receive additional information about your visit to the Site, including the pages you view, the links you click and other actions you take in connection with the Club Site and the products and services offered through it. This data is used to make the site design more efficient. Like most websites, the Club site also uses “cookies”, which are small text files placed on your computer by the web server when you visit the Site.
