X-GOLF SAUK VALLEY – BOOKING POLICY 1. Reservations - Advanced reservations are strongly recommended, especially during evenings, weekends, and peak seasons. - Reservations can be made online, by phone, or in person. - A valid credit card is required to secure all bookings. - Simulator time is sold in hourly increments, per bay, not per player. 2. Arrival & Check-In - Please arrive 10 minutes before your scheduled start time. - Your reserved time begins at the scheduled start time, regardless of when your group arrives. - We may offer your bay to walk-in guests if you are more than 10 minutes late without notice. 3. Cancellation & No-Show Policy -To provide quality service and ensure fair scheduling, cancellations or changes must be made at least 24 hours before the scheduled reservation time. - Cancellations made 24+ hours in advance incur no penalty. - Cancellations made less than 24 hours in advance may be charged up to 50% of the reserved time. - Cancellations made less than 4 hours in advance will be charged 100% of the scheduled reservation. - No-shows will be charged 100% of the scheduled reservation. A valid credit card is required to secure all bookings. 4. Group Bookings & Events - Groups of 8 or more players, or bookings for multiple bays, may require: ~ A deposit ~ A signed event agreement ~ 7-day notice for cancellations or changes - Deposits for group events are non-refundable if canceled within 7 days of the event. 5. Pace of Play - An average group can complete: ~ 9 holes in ~1 hour ~ 18 holes in ~2 hours - Simulator play can vary by group size, pace, and skill level. - Please book adequate time for your group; unfinished rounds are not discounted. 6. Food & Beverage Policy - Outside food and beverages are not permitted, including alcohol. - All guests must comply with state alcohol laws and responsible service standards. 7. Youth & Safety Rules - An adult must accompany guests under 16. - Only one player may swing at a time. - Keep a safe distance from the hitting area at all times. - Failure to follow safety rules may result in termination of play without refund. 8. Weather - As an indoor facility, we operate rain or shine, including extreme temperatures. - Weather conditions do not waive cancellation fees. 9. Equipment & Attire - Guests may bring their own clubs, or rent our house sets if available. - Clean footwear and appropriate attire are required. - Metal spikes are not permitted. 10. Damage & Conduct - Guests are responsible for any damage caused to equipment, bays, or facility. - We reserve the right to refuse service to guests exhibiting disorderly or unsafe behavior. 11. Pricing & Payment - Prices may vary by day, time, and season. - Payment is due at the conclusion of play, unless prepaid. - We accept major credit cards, debit cards, and cash. ----------- X-GOLF SAUK VALLEY – WAIVER & RELEASE AGREEMENT PLEASE READ CAREFULLY. BY BOOKING ONLINE, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS. This Waiver and Release Agreement (“Agreement”) is entered into by the participant (“Participant”) in consideration for access to and use of the facilities, simulators, equipment, and services provided by X-Golf Sauk Valley (“Facility”). 1. ASSUMPTION OF RISK Participant understands and acknowledges that participation in golf-related activities and the facility involves inherent risks, including but not limited to: Being struck by a golf club or ball Slips, trips, falls Equipment malfunction Injuries caused by other participants Participant voluntarily assumes all risks, known and unknown, associated in and/or with participation at the Facility, whether caused by Participant or others. 2. RELEASE OF LIABILITY To the fullest extent permitted by law, Participant releases, waives, and discharges X-Golf Sauk Valley and its owners, employees, agents, contractors, and affiliates from any and all claims, demands, actions, or causes of action arising out of or relating to: Injury, disability, or death Property damage or loss Negligence of the Facility, its employees, or others This release applies to acts of ordinary negligence, but does not apply to acts of gross negligence or willful misconduct. 3. INDEMNIFICATION Participant agrees to indemnify and hold harmless X-Golf Sauk Valley from any claims, damages, or expenses (including attorney fees) arising from: Participant’s actions Violation of Facility rules Damage to property or equipment Injury to themselves or others 4. SAFETY RULES Participant agrees to follow all Facility safety rules, including but not limited to: Only one person in the hitting area at a time No swinging clubs outside designated areas Maintain safe distance from anyone swinging No roughhousing or unsafe conduct Failure to follow rules may result in termination of play without refund. 5. ALCOHOL CONSUMPTION If consuming alcohol on premises, Participant agrees to: Consume responsibly Not operate a vehicle if impaired Not provide alcohol to minors Participant releases X-Golf Sauk Valley from any liability arising out of alcohol consumption, intoxication, or related behavior, including after leaving the premises. 6. EQUIPMENT USE & DAMAGE Participant agrees to use Facility equipment responsibly. Participant is responsible for the cost of repair or replacement for any damage caused by abuse, negligence, or intentional acts. 7. PERSONAL PROPERTY Participant acknowledges that the Facility is not responsible for loss, theft, or damage to personal property brought onto the premises. 8. HEALTH & MEDICAL Participant represents that they are physically able to participate in golf activities. In the event of injury, Participant authorizes Facility to: Seek medical care Provide basic first aid Contact emergency services Participant is responsible for all medical expenses incurred. 9. PHOTO & VIDEO RELEASE Participant grants the Facility permission to use photographs, video, or likeness for promotional purposes without compensation, unless explicitly revoked in writing. 10. MINORS Participants under 18 years old must be accompanied by a parent or legal guardian. The parent or guardian: Accepts all terms of this Agreement on behalf of the minor Assumes all risks Releases and indemnifies the Facility to the fullest extent permitted by law 11. GOVERNING LAW This Agreement shall be governed by and interpreted under the laws of the State of Illinois. 12. SEVERABILITY If any part of this Agreement is held invalid, the remainder shall continue in full force and effect. 13. BINDING EFFECT This Agreement is binding on Participant, their heirs, executors, successors, and assigns.
